Terms & Conditions Self-Guided Tours

“The Roadery” is a brand name licensed by the J.C. Bromac Corporation (“EagleRider”). When booking a Tour branded as “The Roadery”, participants enter into an agreement with EagleRider and EagleRider is solely responsible and liable for all aspects of the motorcycle tour.

 

TOUR CONFIRMATION

With your signature on the Self-Drive Booking Form you accept these Terms and Conditions as a binding contract between EagleRider and yourself, as the Self-Drive Tour Participant, please read them carefully. EagleRider cannot accept any tour participant without a signed Self-Drive Tour Booking Form.

 

RELEASE AND WAIVER

Every participant in an EagleRider Motorcycle Tour is required to accept and sign a Rental Agreement and release and waiver form of rights before the tour begins. EagleRider cannot accept any tour participant without a duly signed release and waiver form. Our agents can provide a copy of the release and waiver form.

 

AGENTS AND REPRESENTATIVES

EagleRider agents and travel industry business partners are representing us, but are not a party of this contract, nor are they in any event responsible or liable for any failure to provide any services as may be described in our literature pertaining to the contract.

 

MOTORCYCLE RENTAL / SECURITY DEPOSIT

The following late-model rental motorcycles are provided as part of the tour package:

For an additional fee, the following motorcycle models are also available for any of our tours:

Most of the bikes are available with medium-sized saddlebags and a windscreen. Please let us know your preferences during booking and we will try to accommodate them. Specific bike models and equipment are subject to availability. Colors may vary. EagleRider reserves the right to substitute the motorcycle confirmed to tour participants. Should EagleRider not be able to provide confirmed motorcycle a similar or better model will be provided to the Participant. This constitutes the maximum liability of EagleRider. A security deposit has to be paid to EagleRider Motorcycle Rental at the time of motorcycle pick-up. The amount of this security deposit varies on whether the Client chooses to purchase Theft & Damage Waiver Insurance. Security Deposits can range from $100 – $3.000. EagleRider reserves the right to adjust the amount of this security deposit and deductible without notice. This security deposit will be refunded upon the return of the undamaged motorcycle.

RENTAL REQUIREMENTS

 

ROADBOOK

Standard Self-Drive Tours will be provided with a Co-Pilot guidebook.  The co-pilot guidebook will contain basic travel information within the United States and Canada, day-by-day itinerary, route suggestions, and points of interest.  Any standard tours booked within 30 days of the participant’s travel dates may not receive a hard copy of the Co-Pilot guidebook.  In this case a PDF copy may be sent to the participant via email.  Custom Self Drive Tours over 8 days will also receive a Co-Pilot guidebook as long as the tour is booked at least 30 days prior to the tour start date.  A Co-Pilot guidebook is not guaranteed for any Custom Self-Drive Tours booked within 30 days of the tour start date.

 

HELMETS (INCLUDED)

Half-helmets are provided with motorcycle rentals and tours. 3/4 helmets and full-face helmets are available by request subject to availability or can be purchased at many of Eaglerider’s rental stations. We recommend participants to bring their own helmets for style and comfort reasons

 

HOTELS

The hotels we use are booked based on availability and the exact properties will not be released until confirmed.  The hotels we use are typically 3 star motorcycle friendly properties. Our goal is to create an authentic experience for our guests and wherever possible and practical, we avoid mass-tourism accommodation and pick hotels or motels with a special charm and a character that is unique to each location. Sometimes though our choices are limited and we have to choose more “standard fare” or rustic hotels/motels, especially close to National Parks.

 

RESERVATION AND DEPOSIT

A $500 USD non-refundable booking deposit is required at the time of booking.  The remaining balance will be due once the hotel accommodations have been confirmed.  In special circumstances the final payment may be taken at a later date.  These circumstances will be determined on case-by-case basis.  By signing the Self Drive Tour booking form you give EagleRider permission to charge your credit card the remaining tour balance once your hotel accommodations have been confirmed.  Payment by wire transfer is acceptable and must be sent 90 days prior to the tour start date.  EagleRider reserves the right to cancel the Self-Drive Tour reservation and charge a cancellation fee if payment is not received. Self-Drive Tours less than 8 day / 7 night / 6 riding days will require the full tour amount to be paid at the time of booking.

 

ITINERARY CHANGES

Any changes to the itinerary after the booking is confirmed may carry a change fee.  A change to the itinerary includes and is not limited to changing the route, hotels, travel dates, etc.

 

ALTERATIONS TO TOUR SCHEDULE

Any alterations made to the itinerary while on tour will be at the participant’s expense.  This includes and is not limited to changing hotels, destinations, adding/subtracting tour days etc.  Any unused hotels on tour will not be refunded.

 

WEATHER CONDITIONS

Weather conditions are not guaranteed for our Self Drive Tours.  EagleRider cannot be held liable for any unpleasant and unsuitable weather conditions.  No refunds shall be granted for such conditions.

 

SEASONAL/BIKE RALLY SURCHARGES

A surcharge may apply at certain locations during major bike events such as Sturgis, Daytona, Laughlin River Run etc.  Seasonal surcharges may apply during peak holiday periods.  Examples include New Years, Memorial Day, Independence Day, Labor Day, Thanksgiving, Christmas, etc.  Hotels may charge a surcharge for special events such as, conventions, conferences, special events, etc.  Any surcharges will be passed to the participant.

 

RELEASE AND WAIVER

Every participant in an EagleRider Self Drive Motorcycle Tour is required to accept and sign a Rental Agreement and Liability Release Waiver before the Self Drive Tour begins. EagleRider cannot accept a tour participant without these signed forms.

 

CUSTOMER ORIENTATION

Every participant will receive a full orientation to the motorcycle. The participant orientation will cover safe motorcycle operation, the participant’s maintenance responsibilities, as well as some local and state traffic laws.

 

FUEL AND OIL

Fuel and oil is not included in Self-drive Tours.  The cost of fuel and oil will vary depending on time of year and location.

 

CANCELLATION AND REFUNDS

A Self Drive Tour may be cancelled without cancellations fees if the tour is cancelled 30 or more days prior to your tour start date.  However, cancellation fees and refund amounts will be determined on a case-by-case basis.  Any cancellation fees may be applied to a future tour booking anytime within a twelve (12) month period following the cancellation date.

 

RESPONSIBILITY

EagleRider is responsible for providing the services listed in the tour description according to the local standard and the accurate description of services offered in its literature. EagleRider is selecting carefully and is constantly checking its contractors, such as hotels and restaurants. EagleRider is responsible for conscientious travel preparations. EagleRider and The Roadery are not responsible or liable for any accidents and cannot be held liable in any way for any occurrence in connection with the operation or the client’s participation in connection with the tour, which might result in injury, death or other damage to the client, his property, or his family, heirs, or assigns. EagleRider and The Roadery are not responsible for any delays, changes in schedule or other conditions.

 

COMPLAINTS AND SUGGESTIONS

TOUR RATES, RENTAL RATES AND MOTORCYCLE COSTS

Fares quoted on our website and in our brochure are those in effect at time of printing. If cost factors including but not limited to: hotels, motorcycles, insurance, international currency fluctuations, etc. dictate the need for an increase in fare EagleRider may do so at any time prior to 60 days before departure. A fare increase has never happened, however, should this become the case the participant has the right to receive full refund if so desired.

 

INSURANCE

EagleRider recommends that you take out adequate travel, health and accident insurance as well as trip cancellation insurance with your agents. EagleRider currently offers a Theft and Damage Waiver, as well as Supplemental Liability Insurance.  Please ask your booking agent for further information. All insurance, coverage and waivers are subject to the express terms and conditions of the rental contract and do not include coverage for injury, personal property, or damage as the result of negligence such as illegal use or use of rental while under the influence of drugs or alcohol. A Police Report is required for all damages or accidents. All damages to rented motorcycle without a police report is considered Renter’s fault

 

FREE TRANSFERS

EagleRider will provide hotel pickup/drop off service to and from your hotel as long as the hotel is within a 7-mile radius of our location.  Another option is to take a taxi.  Our location will reimburse up to $15.00 USD/CAD as long as you save the receipt. Restrictions may apply at various locations.

 

STORAGE

EagleRider will provide storage for participant’s additional luggage at the pick-up location for round trip tours.  Storing luggage at the pickup location for one-way tours will not be possible.  EagleRider is not responsible for lost or stolen items.

 

CREDIT CARDS

We accept Visa, MasterCard, and American Express.

 

PAYMENT BY CREDIT CARD or WIRE TRANSFER

Payment of $500 USD Tour Deposit can be made by the following credit cards, VISA, Master Card, or American Express. Balance payments can also be made by wire transfer.  In this case the balance amount must be credited on the EagleRider account 90 days prior tour start date.

 

INDEMNITY AND WAIVER/RELEASE OF LIABILITY

Motorcycle tour participants, on their behalf and on behalf of their heirs, personal representatives, successors and assigns (collectively “heirs and assigns”), in consideration of the rental and/or participation in the tour waive, release, discharge, covenant not to sue and agree to indemnify, defend and hold harmless Eaglerider, The Roadery and each party’s respective directors, officers, owners, employees, agents, affiliates, tour guides and assigns (each, a “released party” and collectively, the “released parties”), from and against any and all demands, claims, damages, losses, liabilities, attorney fees, legal proceedings, whether civil or criminal, penalties, costs, fines, or other sanctions of any kind (collectively, “liabilities” or “liabilities”), that may be incurred by or accrue against any released party directly or indirectly arising out of or relating in any respect to participant’s participation in a tour.

 

 

PRIVACY POLICY

 

This is the J.C. Bromac Corporation (“EagleRider”) privacy policy (“Privacy Policy”). EagleRider is affiliated with EagleRider, Inc. and Eagle Travel Systems, Inc. and EagleRider Finance LLC is a subsidiary of EagleRider (all such entities along with EagleRider are collectively referred to as the “EagleRider Group”). This privacy policy discloses the privacy practices for the web site eaglerider.com and theroadery.com, a website operated by EagleRider.

 

Purpose of this Privacy Policy

We at EagleRider recognize the importance of protecting your personally identifiable information (such as your name, telephone number, e-mail address and other contact information, collectively, “PII”) that you provide to EagleRider. This Privacy Policy sets forth our policies regarding the collection, use and disclosure of your PII both through our online and offline operations. This Privacy Policy also explains how you can correct or change the PII we hold about you, or opt out of receiving certain marketing materials.

The purpose of this Privacy Policy is to tell you how EagleRider strives to better serve you by keeping you informed of promotions, products and services, while, at the same time, safeguarding your PII. Our intent is to bring you offers and discounts that we believe are relevant to your interests offered by and through EagleRider and EagleRider’s affiliates and other non-affiliated companies with whom we have business relationships.

This Privacy Policy is incorporated into, and part of, the Terms and Conditions, which govern EagleRider’s web site at www.eaglerider.com (the “Site”).

What Personally Identifiable Information EagleRider Collects and How it is Collected

When you make a reservation, rent a motorcycle or other vehicle, we need to collect certain information about you in order to provide and improve our services. The service that you chose will determine what information we collect from you. This information may include, but not be limited to:

Name
Email Address
Home and/or Business Address
Telephone Numbers at which we can contact you
Your Date of Birth
Method of Payments (credit card and expiration date)
Driver’s License and Province/Country of Issuance 
Your preferences as to the type(s) of vehicles rented and the timing of such rentals

When you rent a vehicle, we will also record information that details your rental (e.g. the type of vehicle you rented, where you rented the vehicle, where and when you returned the vehicle, payment arrangements, insurance preferences, gas consumption, mileage and other information related to the vehicle).

We may also need certain information from you when you request any of the following services or equipment: Special Needs/Optional Equipment; and Special Offers/Discounts.

How we collect this information will depend on how you use our services. We may collect this information directly from you by telephone, fax, email, at the counter, upon completion of an application or enrollment form, or through your use of our Site or the Internet. To the extent you use our Site, we may also collect information about your use of our Site, transactional and account information, e-mail and other information related to communications to our Site. We may also collect information about you indirectly through a travel wholesaler, aggregator, tour operator, travel agent, an account program in which you or your employer participates or through one of our partner programs when you deal with us through those means. Additionally, our franchisees, affiliates and third parties may provide us with information about you.

You may choose not to provide some of your PII to us, but this may prevent us from providing our services to you, or limit our ability to provide you with the level of service that you would otherwise expect from us.

 

How Personally Identifiable Information is Used and Disclosed by EagleRider

Usage
 We strive to ensure that we give you a stress-free rental experience and are dedicated to building a rewarding and lasting relationship with every customer. In order to provide the level of service we believe you expect from us, we may use your PII for the following purposes:

To provide the services and offerings that you request, and to communicate with you regarding such services and offerings;
To do all things necessary to administer those services;
To research, develop, manage, protect and improve our Site and services;
To maintain and develop our service-oriented software and other business systems;
To analyze data, or to have a third party do so on our behalf.

We also use your PII information or some discrete part such as your email address for other purposes. For example, such information may be used to process and track your transactions and to send you information about our and our affiliates’ and business partners’ products and services and other information and materials that may be of interest to you. If you use our Site, information may also be used to evaluate what portions of our Site are visited more often than others, determine where visitors came from, where they go, and how long they stay on a particular page, or on our Site in general.

We may match information collected from you through different means or at different times, including, for example, information collected online and offline, and use such information along with information obtained from other sources, including third parties. To do this, it is often necessary to share this information with carefully selected vendors and business partners we work with, such as companies that manage accounts, offer affinity, frequent-user, and reward programs, and companies that perform marketing services and other business operations for us. Disclosing
We may disclose your PII to affiliated and non-affiliated organizations including, for example:
To your company or organization if you use our services under a corporate or other commercial account;
To entities that provide services on our behalf;
To your credit card issuer;
To credit reporting and fraud checking agencies;
To debt collection agencies, if you fail to pay monies owed to us;
To government or private organizations responsible for the processing or handling of traffic or parking related violations;
To driver licensing authorities, directly or through intermediary organizations, when needed to verify compliance with EagleRider’ safe driver criteria for qualified drivers and/or to verify license information;

To government, regulatory and law enforcement agencies where the disclosure is required or authorized by law, and otherwise as we believe is necessary or appropriate to satisfy any law, regulation or other governmental request, to operate our Site properly, or to protect or defend our rights or the rights or well-being of our employees, users or others or if you are involved (or are suspected by governmental authorities or our security functions to be involved) in any illegal activity, even without a subpoena, warrant or court order.

We may also disclose your information to our franchisees, affiliates and non-affiliated business partners for their use both on our behalf and for their own business purposes. For example, our franchisees, affiliates and business partners may use and may have previously used such information so as to allow said parties to send you information about their products and services and other information and materials that may be of interest to you. You may opt-out of us disclosing your PII for these purposes through one of the methods described in this policy.

We may also share your information with other non-affiliated third parties, such as entities that provide services for or through our Site or for our business (e.g., advertisers, ad servers, content providers, services providers, credit card processors, fulfillment services providers, e-mail list hosting companies and distribution companies) that use such information on our behalf consistent with this Privacy Policy. These types of third parties are not permitted to use your information for any secondary purposes.

Franchisees

Some EagleRider locations are owned and operated by an independent franchisee that is neither owned nor controlled by EagleRider or any other member of the EagleRider Group, EagleRider. Each franchisee collects PII and uses the PII for its own purposes. EagleRider does not control the use of this information or access to the information by the franchisee and its associates. The franchisee is the merchant who collects and processes credit card information and receives payment for the motorcycle rental services. The franchisee is subject to the merchant rules of the credit card processors it selects, which establish its card security rules and procedures. This privacy policy does NOT apply to a franchisee’s web site. Franchisees may also use email campaigns and other methods of telephone, electronic, and direct mail solicitation without our consent or knowledge and are solely responsible for their content and methods of identifying and contacting addressees.

 

Web Site Tracking and the Use of Cookies and Other Technologies

If you use our Site, certain PII may be collected in the course of your use of our Site. As with many web sites, we may use both session based and persistent “cookies” and/or other technology (e.g., web bugs, e-mail bugs, clear GIFs, web beacons, tracker GIFs and “clickstream” data logs) in our Site and other web sites, or in our electronic communications with you, to enhance the functionality of our Site and services and to make your transactions and other activities more convenient and efficient. These technologies may vary, but in many cases may involve a small file stored locally on the computer used to access our Site (commonly referred to as a ‘cookie’), and may be used to store and collect information relating to your viewing and use of our Site and our correspondences with you. We use cookies to track web site trends and patterns. This helps us understand our users needs better and improve areas of our Site. We store information we collect through cookies to create a profile of our users. A profile is stored information we keep on individual users that details their travel preferences, rental history and behavioral activity, and to minimize the need for you to re-enter information on our Site. Consequently, collected information is tied to a user’s PII to provide offers and improve our services and content within our Site.

Most cookies expire after a defined period of time, or you can delete your cookie file at any time. Most web browser software is initially set up to accept cookies. You can reset your web browser software to refuse cookies or to indicate when a cookie is being sent. However, some parts of our Site will not function properly or may be considerably slower if you refuse cookies. For example, without cookies, you will not be able to set personalized preferences, and/or may have difficulty completing transactions.

We may collect your computer’s IP (Internet Protocol) address and domain name address, the identity of your Internet service or access provider, the type of web browsing software you use, your computer’s operating system, the URL of the web page from which you came to visit our Site and the language you selected for your web browsing software (collectively referred to herein as “clickstream data”). We use these technologies, for example, to identify our users, to help diagnose problems with our server, and to administer and promote our and our affiliates’ and business partners’ web sites and services.

Third parties (including, but not limited to, software vendors, advertisers, ad servers, content providers and services providers) may also use similar technologies by or through our Site or third party web sites. In connection therewith, such entities may collect information about you and your usage activity on this and other web sites. We have no responsibility with respect to what information such third parties track or collect, or for any tracking, data collection or other activities of such third parties. We may use third-party service providers to serve ads on our behalf across the Internet and sometimes on this site. They may collect anonymous information about your visits to our Web site, and your interaction with our products and services. They may also use information about your visits to this and other Web sites to target advertisements for goods and services. This anonymous information is collected through the use of a pixel tag, or similar technology which is industry standard technology used by most major web sites.

 

Analytics

Analytics is the process of tracking Internet Protocol addresses to determine page views, search engine optimization (the process of improving rankings in search engine results) and responses to key AdWords selected by us. Like many companies, we offer tools for user tracking on our website. As part of this process, a piece of Javascript is rendered on every page of our website and when an end user such as yourself loads that page on their browser, you will automatically send a request to the provider of the snippet(s), which could allow said provider to identify your Internet Protocol address. We currently use Google and Yahoo as such providers, however, in the future may use additional providers. Our Site may contain links or references to other web sites outside of our control, and the privacy policies of these sites may differ from our own. Please be aware that we have no control over such web sites and our privacy policy does not apply to such web sites. We advise you to check the privacy policies of such sites before disclosing any PII via such sites.

 

Framing

Occasionally when linking to another site from eaglerider.com, you may still see EagleRider’s logo or an eaglerider.com frame. The reason for this is, to provide you with a seamless experience when visiting our web site. In these cases, you are no longer on eaglerider.com but will now be on a different web site, not owned or controlled by EagleRider and therefore the information collection practices of the third party’s site may differ from EagleRider’s. The privacy policy of a third party site will govern how information collected from you is used by the owner of the site. You can always know what site you are on by checking the location bar within your browser.

 

How We Protect the Security of Personally Identifiable Information

The security of your PII is an important concern to us. We exercise reasonable care in implementing generally accepted standards of technology security in order to protect information collected via our Site from loss, misuse and unauthorized access, disclosure, alteration or destruction, such as firewalls and Secure Socket Layer (SSL) encryption for some of your more sensitive PII.

Unfortunately, “perfect security” does not exist on the Internet, and no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your information, we cannot guarantee that any information stored on our servers, or transmitted to or from a user, will be free from unauthorized access. For example, and in particular, unencrypted e-mail is not a “secure” means of communicating with us, since e-mail may be intercepted by a third party in the course of its delivery. By using our Site and corresponding with us, you acknowledge that you understand and agree to assume these risks.

We will never request that you send us any sensitive PII, such as your credit card number, password, membership number or pin number, in an e-mail or into a web site that is not located at the eaglerider.com domain name. If you receive an e-mail or other correspondence requesting that you provide any such information via e-mail or to a web site that is not on such domain name, please do not provide such information, and report such request to our privacy officer at privacy@eaglerider.com.

 In the unlikely event that we believe that the security of your PII in our possession or control may have been compromised, we may seek to notify you of that development. If a notification is appropriate, we would endeavor to do so as promptly as possible under the circumstances, and, to the extent we have your e-mail address, we may notify you by e-mail.

 

How to Correct or Update Personally Identifiable Information that EagleRider Maintains Or Opt Out of Receiving Marketing Materials from EagleRider

You can opt-out of our use and disclosure of your PII for marketing purposes and customer satisfaction surveys, and/or withdraw your prior consent for same, by the methods provided below. If you do so, your consent will be withdrawn; however, it is possible that you may receive correspondences scheduled prior to our receipt and processing of your opt-out request.

To Opt Out of Email Campaigns: You may reply to a promotional or marketing e-mail that you have received from us by following the opt out procedures described in the promotional or marketing email. (If you use more than one e-mail address, then send your opt-out e-mail from each of your e-mail addresses.)

Your option not to receive promotional and marketing material: (a) shall not preclude us from corresponding with you, by e-mail or otherwise, regarding your relationship with us (e.g., your account status and activity or our responses to questions or inquiries you pose to us, or confirmations for existing reservations); (b) shall not preclude us, including our employees, contractors, agents and other representatives, from accessing and viewing your PII for our internal business purposes; and (c) shall not preclude us from disclosing your PII as described in this Privacy Policy for purposes other than sending you promotional and marketing materials.

Applicable Law and Jurisdiction

This Privacy Policy shall be governed by the laws of the United State and the State of California, without regard to conflict of law principals. By providing any PII to us, you fully understand and unambiguously consent to the transfer of such PII to, and the collection and processing of such PII in, the United States and other countries or territories. You agree that any cause of action that may arise under this Privacy Policy shall be commenced and be heard in the appropriate court in the State of California, County of Los Angeles. You agree to submit to the personal and exclusive jurisdiction of the federal or state courts located within Los Angeles County in the State of California.

 

Changes to this Privacy Policy

We reserve the right, at our discretion, to change, modify, add, or remove portions from this Privacy Policy at any time so visitors are encouraged to review this Privacy Policy at the inception of each session.

 

Your Acceptance of this Privacy Policy

By using our Site, or otherwise providing your PII to us, you signify your acceptance of our Privacy Policy. If you do not agree to this policy, please do not use our Site or provide any PII to us.
